General insight into the construction process

The general supervision and co-ordination of construction in the State is performed by the Ministry of Economics.

Construction may be initiated by an owner, possessor, lessee and user of the immovable property or an authorised person by submitting a construction work submission-registration card to the building authority of the relevant administrative territory.

The building authority shall, within 10 working days, examine the conformity of the relevant construction intentions and issue a planning and architectural order or provide a substantiated written refusal (public discussion regarding the intended construction should be ensured, if the construction substantially impairs living conditions of the population, substantially reduces the value of immovable property or substantially affects the environment, but it does not require the environmental impact assessment in accordance with the Law On Environmental Impact Assessment)

The term of validity of the planning and architectural order is two or four years (depending on each individual case)

The planning and architectural order is the basis for building design work, but does not give the right to commence construction work.

Building design can be developed by natural persons who have received a relevant construction practice certificate for one of the types of design work, as well as legal persons registered according to the procedures specified by regulatory enactments regulating construction work, which employ certified specialists in the field of design.

Building design work has to be performed in one or two stages depending on the degree of complexity - the stage of a technical design or the design sketch stage and technical design stage.

The developed building design has to be submitted to the building authority, which has to take its decision within 15 working days. If the building design is accepted, the client may submit an application for the receipt of a construction permit to the building authority. The client may submit a refusal of the building authority to approve the building design to the relevant local government for re-examination. If the client is not satisfied with the decision of the local government, it may be appealed to a court.

The construction work has to be commenced during two years (this term can be extended)

In order to receive a construction permit, a client has to submit documents mentioned in article 116 of the General construction regulations to the building authority.

The building authority has to issue the construction permit within five working days. Under certain circumstances the construction permit may me cancelled.

The preparation of construction work and the construction work itself may be performed by a builder or a person registered in the Construction Merchant Register.

Acceptance of a structure for service shall be proposed by a client or a builder to the respective building authority.

The respective building authority takes decision within 10 working days. A responsible official of the local government approves the report within five working days. The structure shall be considered as accepted for service on the day of the approval of the report.
