State fee according the Civil Procedure Law

According to Paragraph 34 of the Civil Procedure Law for each statement of claim – original claims or counterclaims, applications of a third person statement of claim with a separate claim for the subject-matter of the dispute, submitted in a procedure already commenced, applications in special adjudication procedure cases, and other claims applications provided for in this Section submitted to the court – a State fee shall be paid.

 

In regard to claims assessable as a monetary amount a State fee shall be paid in the amount set out as follows:

In regard to other claims which are not financial in nature or are not required to be evaluated a State fee shall be paid in the amount of 71,14 EUR.

 

For application in special adjudication procedure a State fee shall be paid in the amount of 42,69 EUR, for application in a case regarding insolvency proceedings of a legal person submitted by a creditor a State fee shall be paid in the amount of 355,72 EUR, for application in a case regarding insolvency proceedings of a legal person or natural person submitted by a debtor a State fee shall be paid in the amount of71,14 EUR, for application in a case regarding legal protection proceedings a State fee shall be paid in the amount of 142,29 EUR, for application in a case regarding insolvency or liquidation of credit institutions a State fee shall be paid in the amount of355,72 EUR.

 

For applications regarding an undisputed enforcement, for applications regarding European order for payment in accordance with Regulation (EC) No 1896/2006 of the European Parliament and of the Council of 12 December 2006 creating a European order for payment procedure or voluntary sale of immovable property by auction through the court a State fee shall be paid in the amount of 2 %of the amount of the debt or value of the property to be returned or voluntarily auctioned, but not exceeding 498,01 EUR.

 

For applications regarding compulsory enforcement of obligations according to warning proceduresa State fee shall be paid in the amount of 2 % of the amount of the debt.

 

For application regarding corroboration of the immovable property in the name of the acquirer a State fee shall be paid in the amount of 71,14 EUR.

  

For applications regarding issuing a writ of execution on the basis of a judgment of a permanent arbitration court or the recognition and enforcement of a decision of a foreign arbitration courta State fee shall be paid in the amount of1 %of the amount of the debt, but not exceeding 284,57 EUR.

 

For applications regarding securing of a claim or provisional measures a State fee shall be paid in the amount of0,5 % of the amount claimed, but not less than  71,14 EUR.

 

When submitting an ancillary complaint regarding a court decision, except the decision by which release from payment of the court expenses in the State income is refused, a State fee shall be paid28,46 EUR.

The State fee for a notice of appeal shall be paid in conformity with the rate to be paid upon submitting a statement of claim (an application in a special adjudication procedure case), but in regard to disputes of a financial nature – with the rate calculated in conformity with the disputed amount in a first instance court.

 

For application regarding infringements and protection of copyright and related rights, database protection (sui generis), trademarks and geographical indications, patents, designs, species, topography of semiconductor products, as well as for disputes that are settled under the Patent Office of the Republic of Latviaa State fee shall be paid in the amount of213,43 EUR.

 

In regard to a statement of claim in a case regarding divorce a State fee shall be paid in the amount of142,29 EUR, but for a statement of claim for divorce with a person who has been declared missing, or who has been sentenced to a term of deprivation of liberty of not less than three years – 14,23 EUR.

 

For applications regarding securing of evidence, if such application is submitted prior to the bringing of the action a State fee shall be paid in the amount of 28,46 EUR.

 

For complaints in cases of legal protection proceedings, for complaints in cases of insolvency proceedings in relation to a decision of the meeting of creditors, for complaints in relation to a decision or actions of an administrator of insolvency proceedings, for complaints regarding decisions of the State Agency “Insolvency Administration”, as well as the performance of the activities specified in Articles 33 and 37 of Council Regulation (EC) No 1346/2000 of 29 May 2000 on insolvency proceedings a State fee shall be paid in the amount of 21,34 EUR.

 

For complaints in relation to decisions or actions of a bailiff or sworn notary a State fee shall be paid in the amount of 21,34 EUR.

 

When submitting a writ of enforcement or another enforcement document for enforcement a State fee shall be paid2,85 EUR.

When submitting an application regarding the recognition and enforcement of a decision of a foreign court a State fee shall be paid28,46 EUR.
